Oklahoma has an express framework — the Oklahoma Gestational Agreement Act, 10 O.S. §§557.1 et seq., in force since 2019. Compensation must be reasonable and negotiated in good faith, and may not be conditioned on the genetic traits of the child, though it may vary with the number of embryos transferred, procedures undertaken, number of children, or length of pregnancy.
This is the critical point in Oklahoma. The agreement must be validated by a court before any transfer of gametes or embryos. An unvalidated agreement is not enforceable — if you proceed to transfer without it, you are outside the statute's protection entirely. Do not begin medication until you have confirmed validation has been obtained.
You must be at least 21 at signing, have given birth to at least one child, complete a physical medical evaluation and a mental health consultation, and satisfy 90 consecutive days of Oklahoma residency immediately before signing — unless an intended parent meets that residency instead. The residency rule is genuinely law here, not agency policy.
You and your spouse must have counsel separate and independent from the intended parents', with each attorney signing a written statement identifying their client and confirming they advised on the legal consequences. On cost: the agreement must identify who bears reasonable medical, legal and travel expenses including if the agreement is terminated, and the intended parents may agree to pay or reimburse you. It is not automatically assigned to them.
